MI, I guess there was no category in the govt list for: "capable of producing but P & A'd as planned by operator". Labelling it a 'non-producing well' probably doesn't mean 'incapable of producing'.
I hasten to add that I'm not a lawyer and all my legal knowledge has come from watching Law & Order and Boston Legal:)
