    Response from ASIC
    XTV Networks Limited (“XTV”)
ASX refers to your online report dated 8 October 2017 querying how long an entity such as XTV can remain in suspension and requesting further information on XTV.
As set out in ASX Guidance Note 33, ASX’s policy is to remove from the official list any entity whose securities have been suspended from trading for a continuous period of three years. The removal will usually take effect from the open of trading on the first trading day after the expiration of that three year period.
XTV was suspended on 16 June 2016. Accordingly, in the event that XST is not reinstated to trading prior to Friday, 14 June 2019, it will be automatically removed from the ASX Official List on Monday, 17 June 2019.
In order for an entity to have its securities reinstated to trading, the entity must, at a minimum, comply with the on-going requirements set out in Chapter 12 of the ASX Listing Rules, including having a level of operations and financial condition sufficient to warrant the quotation of its securities.
Entities that have been suspended for an extended period of time, such as XTV, are likely to be required to provide a substantive announcement to the market setting out, among other things, information in respect of their ongoing operations and financial condition, prior to its securities being reinstated to trading.
Based on XTV’s announcement of 4 September 2017, we expect XTV’s next update to the market to be made on or before Monday, 6 November 2017.
Thank you for your query. We hope this letter has helped clarify matters for you.
