well you are right , some of the shares ANZ sold were off-market deals arranged where the companies found new or existing shareholders to buy them off ANZ, those deals "might" have had some special claw-back provision in the event that ANZ loses its court cases ( although I doubt it, I would not be keen to buy shares with any such condition ).
But the ones they sold actually onto the market, no way they can get them back except to buy them at whatever the market price is in the future.
