I agree with Albers wrt MOG's upcoming "speculative" appeal.

However, he has structured the related transactions in such a way as to almost guarantee his RI will fail, imo.

If he was smart, he would make the Artemis acquisition unconditional

This would remove the current potential sp downside in the event we lose Artemis because funding is not achieved for Braveheart/Cornea.

Removal of that potential downside would support the RI in the first place!!

Unfortunately, he's thinking more about his own risk, ie diluting his Artemis stake without getting his funding.

He should be thinking about what motivates shareholders to part with their dollars and the risk they face under the current structure of the transactions.
