Yes I expect the people involved with the relisting expected some satisfactory early settlement as it would have been a sensible commercial decision if all parties believe (as they did)that their claim was valid. MMX could have simply and without the need for shareholder approval, issued CHM with up to 15% of their stock and the problem would have disappeared. However, they rejected the claim out of hand preferring to believe that the sins of the founding chairman Grimaldi would not be visited on them. So we are heading to court.
If you think the people involved in the funding, relisting and hold tens of millions of shares are not going to ensure CHM has its day in court you are sadly mistaken as they are not going to let a multi-million dollar pay day slip away.
Additionally, AH and Tony Hartnell in particular would have their repretations seriously dented if they can't get CHM to have it day in court. Their involement in the case was a significant part in my decision to buy CHM.
