CHM are certainly fully paid up with AH (their lawyers). In reality this matter cannot drag on for years since MMX need to get the "monkey off their back" otherwise they are at a complete standstill regarding future funding for infrastructure etc.
One might start to suggest that MMX are actually between a "rock and a hard place" - on the one hand they suggest a rigorous defence and that CHM have not one leg to stand on. On the other they are faced with an aggresively rising iron ore price that they obviously wish to capitalise upon.
What to do? Open up the door for a chat and a negotiated settlement (How much??)or continue on with a somewhat blinkered/disorganised plan that CHM will simply go away (wrong).
A great recipe for one of the more interesting corporate court cases for a long while.
Good Punting - by the way don't forget bout that dark thing called coal. Plenty of action in some of the smaller players - e.g. TCM.
