    A local example of how the confusion may arise is probably something like our very own "Webb Dock" where the Crown essentially owns the land the operation exists on, a separate entity called ITSC (a Philippino Government owned entity by way of a Trust) who has the right to the port design, development, commissioning, operation and maintenance and earns the income for stevedoring, on-premises logistics etc as a result and pays a throughput fee to the Crown for this ongoing right. The question here is who owns Webb Dock, is it the State Government or ITSC? the same applies to the situation with regards WHA and who the owner(s) of the chinese company are and whether it is an SOE or a private company. I have now seen both answers and don't know which one is correct but admittedly lean towards it being a private company with a chinese government interest in it either directly or indirectly.

    For WHA the only thing that matters is whether they can meet the conditions of the agreement so to unlock revenue potential and that rests with SAMR at this point.
