As I had posted in BOC thread, it appears that BCL has taken the position that the original agreement covering the Panguna Mine is an international treaty between Australia and Papua New Guinea.
Thus, breaking the agreement would be against the international commitments of both countries
Not sure how the Court will decide on this one
