Like yourself , I'm no legal-eagle, but a right to appeal is....a right and not for the judge to have any say on!
I think under Oz's legal system, only the High Court, deciding matters on LAW [as opposed to fact], decides whether a case has LEGAL merits to be heard or not and therefore. application to appeal to the High Court will be accepted or rejected.
No-doubt a solicitor will fact-check us soon enough!
