Its a reasonable compromise i guess. I'll be getting a copy of the note agreement and checking the covenants and clauses included. Although a price covenant would be funny given the decimation of the current SP, they'd have to set it at 15c or so.
As i've said before if we have the cash then the market can do what it likes for the next 2 years, we'll be primed and ready for the next market rise (remember there is always an next up).
