I would guess their default approach is to honor the arrangements they have in place - not a great look to take advantage of a technicality to screw over your lenders so early in the relationship. But I assume they couldn't anyway, I think the terms of the deal have to be honored as they stand? They couldn't just 'not pay' and ask another party to wait because they want to CR at a higher price in a few weeks - sort of defeats the point of the price that was brokered in the first place.
