    re: Ann: Update on Rooderand Project Legal Pr... Interesting post below from staranaylst on the NKP thread regarding his point of view regarding the court system in SA and the recent "expropriation" ruling.

    I've always been somewhat worried about the deep pockets of Anglo taking the Rooderand license from Alta & PLA, as the Politicians & government must know that both parties have limited funds to develop the project.

    Maybe PLA are fast tracking capital arrangements /discussions for Rooderand now to proof to SA authorities that they can make it happen?

    I think PLA would have already been taken out if it wasn't for the issues surrounding Rooderand. Without Rooderand PLA has very little blue sky for a bidder.

    I think you guys need a reality check on how things work in Africa.

    The law doesn't dictate ANYTHING!

    It is the key polies of the day that dictate the law.

    That is how it has always been in all of Africa. Africa has NEVER been governed by the rule of law.

    It is more important to look after the heads of the government of the day than it is to get a favourable court decision.

    Yes courts exist, but they wield little power in reality.

    In some cultures, such as Chinese business culture, i have heard that they are often surprised that they do not have to give "commission payments" when they do business in Australia. They don't believe that law works at all and are infact unsettled by the fact they haven't paid any money to anybody. This is why the Chinese have been far more successful in places like Africa than Australia. They "buy" the rule of law effectively but it only applies to their business interests.

    I honestly think you guys are wasting your time reading into these court decisions. They are merely words on a page and do not mean anything given how the rule of law operates in Africa. Perhaps its because you guys have nothing better to do than speculate on meaningless court decisions.
