Hi Henry, yes that would be a funny sort of agreement if it didn't have some sort of pricing mechanism, would they be allowed to call something like that an "Off take agreement"? So yes I agree, let's hope we don't go down that path.
So you think having someone that has right of first refusal is an advantage in negotiations, sort of makes the new party offer top dollar so the other party doesn't match it? That's an interesting way of looking at it if so, I was sorta thinking it would make negotiations a bit more complicated or that perhaps they would look elsewhere for the product rather than paying over the odds for it. But I suppose if they want our premium coarse product they may just have to pay that top dollar to avoid Burwill excercising their right of first refusal that you mention.
