The setup seems to be this: POH believe that Mylan owe them money for a matter almost identical to the one that they've already lost on.
They'll drop this matter if Mylan forgive the costs. The issue is that Mylan know that POH doesn't have the funds to sue them, doesn't have the time to sue them, and would likely lose the exact same way as last time.
Whether POH survives is based on the whim and fancy of some group within Mylan who are either annoyed at POH or regard it as a part of a list of pending matters that they'd prefer quickly crossed off.
Depending on nameless corporate officers, I'm sure, isn't where most of us holders wanted to be at this point.
