Well if the Takeover Panel is off on a legal frolic or has completely left the reservation then I guess it will be up to a higher court to determine the matter.
I agree with you that the justification used by the Takeover Panel seemed very dubious, contradictory and illogical on my initial reading of it. And I still argue that its possible that they don't even have juristiction over this matter. If so - any decent lawyer should be able to drive a bus through the holes in legal logic on appeal. I'm assuming there is quite a lot of money at stake here so someone will be getting the best legal advice that money can buy.
We shall see.
