The Termination of Joint Venture Agreement of 12 July said that: "The receiver appointed to Brimstone Resources Ltd currently controls the remaining 40% interest in the mining tenements that comprise the Penny's Find mine."
So I guess that it was the receiver who was spending Brimstone's resources on those failed court cases.
