Actually it really does matter.
An honest mistake can be cured by establishing a defence under s. 1322 Corps Act. That section provides the defendent the basis for a defence against a breach of s. 708A Corps Act.
If it is proven to be deceptive conduct then there will be no defence available under s. 1322.
And ineptitude is not a crime (sadly) unless the conduct can be established to be negligent.
Simple but crucial.
