the key to what Xstate is saying is this

This is despite repeated representations by the defendants that the subscription monies would be paid. Furthermore, at no time have the defendants indicated the substance or the nature of any purported defence to Xstate’s summary judgment application

what you have to ask is how can you go to a judge and ask for more time to delay processes when you have never ever indicated that you would not pay or that you had any dispute what so ever.  and also with the background of having constantly made promises hundreds of times to pay throughout.   Xstate and its solicitors have obviously never been told they have a defence, all they have been told, and all they have on record is non stop indications they will indeed pay up.  So with 247 pages of evidences in an affidavit demonstrating just that point alone, how can the sanston 4 bring forward a defence ?
