My reading is that the government would be required to still to pay ("..SA Health must agree to the terms of their use with GH...or a let the tribunal decide" - my words). Also see http://www.austlii.edu.au/au/legis/cth/consol_act/ca1968133/s183a.html.
Agree the wording was not great. Additionally, there were typos that also made it tricky to interpret.
