I asked the company about this Note scenario and was advised by Volt back in October or November that alternative arrangements for funding were being pursued. I took them at their word then and continue to now. Not least of which due to the point you brought up.It may have been a way to force the hand. We have no understanding what the "unrealistic commercial terms" are and how far apart both sides are in the negotiation. I wouldn't be panicking just yet.
