Unfortunatley not the case, the Superintedents Rep manages the contract on behalf of the client. If the contractor believes the Superintendents ruling is unjust then it will likely and ultimately go to arbitration.
The Superintendent has approved a small amount of the claim which I imagine was due to a change in the scope of the works during the contract. The size of the claim and that it appears to have only been flagged at the end of the works is really head scratching. I would definitely be going for liquidated damages and any other potential claims for workmanship against the contractor.
