Unfortunately I don't fancy the chances of getting that US$3M any time soon, if at all. Attempting to get the tenements back via legal action is also liable to be fairly difficult - if you do any reading about the court system in Ghana , it's famous for being slow, expensive, Kafkaesque and there have been quite a few corruption scandals.
4.35 cash vs 5.65 market cap is still reasonable; the problem is that you have to pay 2.3c (equivalent of 7.2M market cap) to get in at this point.
Unfortunately I don't fancy the chances of getting that US$3M...
