They really don't need to go to this much hassle since an increase in their holding above 20% caused by a rights issue would not trigger the TO requirements anyway.
From the perspective of the little guy HP already has effective control at less than 20%. This TO failed because HP said no, not the little guys.
I guess the positive out of all this is it has got CMM some market attention and the SP is now above 7c rather than under 6c.
