I could be wrong, haven't looked in a while but TO's done by scheme of arrangement only need 75% support and it's done by number of holders, not holding size. Although even if it's by shares held 75% approval could circumvent Hawke's Point?
Schemes of arrangement can only be used in friendly takeovers. New board would suggest this is a possible avenue?
