Hey SB, a barrister once told me “ there are many shades of darkness and grey areas of compliance / governance and its all boils down to how each interrupt the facts.. that’s why we have courts and judges... a judge normally would view a case and determine the intent of the breach” IMO the breach is a breach and should be highlighted, noted and monitored for further improvements..again IMO, I feel we should not sit back and wait but take some action to determine our outcome before it’s too later... if we are going to approach a commercial barrister, then it must be within 48 Hrs, not in 2 weeks.
