Well either the letter that HDY has received is in fact meeting the requirements of 249D or not. It can hardly purport to be such a notice because either it is or it isn't. If it is intended to be a notice pursuant to section 249D ( which it clearly was intended to be) then if it is deficient in some respect then that issue ought to be able to be corrected so that the original purpose and intention will still apply.
The comment in HDY's reply to the ASX query seems more like seeking some wriggle room again IMHO. It will be interesting to know what Bryan thinks of the situation and the comment about the discussions with some of the proponents to withdraw the request . Of course that does not mean that the discussions received a favourable response from the proponents. However, I suggest that readers are meant to get that impression. I wonder if Bryan knows that he has been in discussions ?
