Development agreements can be outcome based . At the finalization of pdt development a party can 'walk' if it believes the pdt will not be successful in the market place . Of course the other party may argue that . Getting the judge/arbitrator to get out the crystal ball is more easily said than done .
But yes we dont know the nature of the agreement. But Id ask you do you think Strides commited itself to commercialize a pdt that was yet to be developed?
