Id have to agree TL but did Corr's convince the arbitrator that tpm has a value and POH suffered a loss and should recieve damages ? How could Corr's illustrate a loss with the continual failure of any derivative from a platform tech to commercialize successfully . Wasn't the agreement outcome based ? Did Mylan conclude that the product development had no commercial legs ? The general sentiment appears rather brave imo . As HT showed water soluble vitamin E doesnt have a commercial track record with injectables despite extensive research . Patent applications are not an indication of future success and may be just a matter of process in conclusion of research undertaken .
However its a crapshoot probably more so than in a court room and you may get lucky .
