Not sure I can agree with you on the 'this [grant money] will have to be repaid' statement. I got the impression that KNL management were in the process of lodging a formal adverse decision review as is usual in any government grant process. Procedural fairness requirements demand that this takes place as a condition precedent to the grant becoming a 'debt' to the Cth. If KNL was off to the Federal Court, methinks they would have stated it. The R&D Update states that KNL is 'defending its position' with the ATO. Sounds internal to me.
