Cant comment on the legitimacy of your assertions as to whether it is a valid claim, however on the issue of representation in the accounts, the R&D grant is not represented on a cash basis it is represented on an accrual basis with a deffered tax asset on the balance sheet for the difference between tax provision and ultimate tax liability/refund. Accounting standards require this as it is a refundable "offset" that requires disclosure.
