If the land owner has been consistent and never entertained a sale or compensation agreement, and the project does not have "Significant Project" status then BND has a harder road. But can still go to land court with a claim that the project is in the States and wider community best interest.
But that is a task convincing a court into a decision which kicks a guy off his land unwillingly. Did you watch the movie "The Castle" ......"tell him he's jokin"
