Col69, I don't think that was what TW was saying.  How I read TW's post is as follows:

Ganesha had previously linked the payout value to the value of TPM (and What a gas had agreed with this)

I.e. the higher the payout the more valuable TPM is etc.

TW is saying the payout will be based on legal technicalities of "contractual violation". Sorry but that is a gross simplification - best I could do on the spot. So we could still end up getting the full $300M, it just doesn't necessarily follow that TPM is worth millions.
