Think we'll see the accountants in and an appeal on the law (as opposed to the facts, which are trial judges domain).
So far facts have been found that CHM contribution was 24%. Dont think that that will be appealed by CHM. I think that they will appeal lack of application of that percentage to the asset and there remains a question as to what constitutes income (ie does it include future earnings.....)
Seems outside of traditional equitable principles for MMX to use CHM money to buy an asset, and for CHM to not get an interest in that asset. It also seems odd that MMX are effectively relying on the fact that they havent made any profit with that asset yet. you dont get the keep the proceeds of naughtiness simply because you havent made any money with the asset yet..........
MMX announcement wording seems curious too. Like their use of the word "invest" to refer to the money that was taken.
