Sino has absolutely no liable position for any legal action against them. CDU management signed off on commissioning and engineering. Those engineers and management have potential civil actions to defend if anyone. CDU management also pressured the use of all of the "high grade" pre mined material changing feom the original plans in order to get money asap. again, i reiterate, it was the Board and management decisions that drove that.
You cant blame a customer for asking for more, only bad management for caving to wishes.
I can quite easily direct blame at 6 people in the company. but its easier to say engineer signatories and Board members who deove decisions.
“Steve, I wast t jumping on Good Cop just explaining the complexities of litigation. Like you said there are plenty to blame. Steve you appear to be on the ball with what’s happening before and now. As I see it, the process plant just doesnt seem to do what it was supposed to do.3mtpa. I pointed out from CDU quarterlies the actual copper grades and recoveries are very good. Is it just the process plant not working that has got us in this mess? I mean if the plant could do 320 days x 1.2%Cu for those days 24 hours a day would Rocklands be a success. If the answer you give is YES, then isn’t the builder of the process plant to blame. The CEO was also employed by the builder, Sinosteel giving a double whammy of who is to blame. Sorry Good Cop I wasnt being smart just saying like trying to hold back the tide. On a note of optimism I heard from very credible source CDU is gunna merge with a Chinese state owned entity already operating in Queensland. The money is done and just hope they can finally get the monkey off their backs♀
