While the court battle has been progressing so has the work on the Hawsons site. ASI would probably really want to aim for either option 1 or 2 as if option 3 came about they potentially would have to pay significantly more for the direct position.
If CAP keep their head down and work up the asset, in theory they shouldn't lose.
