Interesting that if the 459G is accepted ( pretty low hurdles for allegation and subsequent 459G but worth Arena to show displeasure) it only means that there is a possible real claim and possible real defense and it will then proceed in normal " battle of lawyers" format in court.
So initial announcement said that 5.2 mill was made up of 2.5 break fee and 104k interest. So if 104k interest had not been paid by NXE it should have shown on annual accounts? The other 2.5 mill part of claim?
A question to NXE management - were NXE and Arena already in negotiations , mediation in regards to dispute over interest or capital and if so was it noted in june?
