Of note in the announcement regarding the 249D notice was that the board placed the decision of invalidation squarely on the legal firm and attempted to step away from the invalidation of the notice by doing so. A 249D notice requires a decision by the board not an adviser.

What the board has now done is invite a court challenge to not only the validity of the notice but the validity of ALL the shares that are on issue. The move to invalidate a notice that was just over 5% of the company was exactly what I thought they would do.

This board has stacked the shares in its favour, and a straight 249D challenge was always going to be line ball, that is until ALL the shares on issue are challenged through a court discovery process.

So far expenses are $Nil and the impact has been good,...... Annual reports, promissory notes, AGM`s, remuneration strikes etc.

Now the real fun begins with the 2nd AGM in 2 months just 10 days away and resolutions already falling this far out.... What will the requisitioning shareholders of the 249D notice decide to do now....Mmmm
