If MEM was closer to a court ruling the announcement would have centered around an impending decision. The cap raising issue would have blended into the background of the ANN, and focused on a possible ruling.
A possible scenario I think is they've been told they aren't allowed to raise capital/get an advance on the back of estimated future income. TBH I can't see why that can't happen, but I can't say I can recall a company trying something similar.
MEM should really be in suspension while they work all of this out, and I can't work out the reasoning as to why this isn't currently happening.
