Kuddles..reminds me about the "equity' that is generally shown under
Planning Scheme property requirements..in that.'existing use rights' apply
where a Council may decide to change the rules..i.e Zone etc. but
existing property is able to continue to operate under 'non conforming rights'
if indeed existing use does not comply with the new "order"...
So it is..Lakes should not be penalised for just doing what is expected
of it within the existing long standing Permit requirements ...
To be sure, Lake's "existing use" or "non conforming" rights more than
than qualify under Dan's warped view of how the Law, can be let us say,
clumsily rewritten in order to suit an agenda totally at odds with a long
standing Permit system that has served this State well...
Hopefully justice will win out..
