Thats an excellent analysis of the situation and as you say we need to wait and see the Judge's decision.
Any Government that wants to change the law after the event that can be seen as an attempt to protect itself from a dubious decision is not a Democracy . They could be considered to a monopoly or dictatorship ???.
The Judge really has no choice but to uphold the Rule of Law and if not I would hazard to guess that the High Court will.
A negative outcome would turn Contract Law and Democracy on its head and surely that cannot be allowed to happen.
A rule of thumb view is "whoever breaks the law pays"
