siggy, naturally the issue is fundamentally material. However, forgive my ignorance, but at what points, specifically, in a confidential negotiation does the tiny party reveal an impasse(s)? Half way through? thhree-quarters? And if it were a trainwreck should that be disclosed before the end of negotiations as you posit? What would that do, at some point (your choice when) before the talks end? Crush CYP's sp and materially weaken their negotiating position?
Again, naturally CYP is being played. FUji is an international player who very successfully re-branded themselves from a film manufacturer to a biotech, etc. company. They have a bit of experience in war, ehm business.
Finally, based on your knowledge of what's at stake, who would you sack? True, a deal is a deal, but a bad deal is not good for CYP.
Tough calls all around, most seem driven with the rocket fuel of negative emotion. "Off with their heads," is not a helpful mantra based on the knowns today That may change.
