Thats the thing - the ASX doesnt have the power to "make" the company do anything, they can only ensure compliance with the listing rules and delist a company if they repeatedly refuse to comply.
The ASX are caught in the middle a bit as they know a referral to ASIC is a waste of time as ASIC is not interested in this end of the market even though it is where most of the dodgy activity occurs.
