Its interesting that TAM are lodging the case, I just thought they would have simply wrote to MLX and said that unfortunately SH did not approve your deal and we are moving on with NST. See you in court!That's the way litigation usually starts!
However NST isn't stupid either, their HOA with TAM has said we don't really care whether SH's approve our bid, we need TAM to formally cancel the HOA with MLX. So there you go NST have some advice that says if you proceed and the MLX deal is upheld you are unlikely to recover any spend on TAM. Nonetheless I am just interested in the outcome, couldn't care less which way it goes, but god forbid if MLX contract is upheld, for TAM's sake at least.
