Nope I haven't and I wouldn't stand on my digs on this one. however, there is a pretty clear signal between MLX and NST agreement which gives some clue.

1. NST agreement says;
- deal is ok provided MLX agreement can be terminated?
- No better deal is received.

2. MLX in its announcement prior,
does not mention either.

However some have concluded that the MLX HOA does state that no better deal is received prior to Sh vote (or something like that). My observation would be if this was the case MLX would not be stating their case as published.

By the way I am not for one moment backing one horse or the other, but my read is TAM would have thought MLX would drop off which is not the case at this point. NST have made it clear in their HOA with TAM, we want it but you sort out any contractual issues prior to our offer being taken up. NST aren't buying into any defence, it seems however they could be funding a legal defense if they want TAM that badly.

If TAM had its time over again, I think they would have brought MLX to table well before the NST deal was signed. this stuff puts undue pressure on the BOD. remember, if this case takes months to sort out the NST deal cannot move forward until adjudication.
