nobody saw the terms of the contract, so concluding that Tyrian were in breach is highly speculative, as it is based on nothing more than a few bits of disinformation provided by a known bullcrap-poster extraordinaire with questionable intentions (this has been confirmed on multiple threads that the guy posts on).
given that we have been told in at least 3 seperate announcements from Tyrian that settlement money from Bayer is expected and negotiations are in their final stages, it would be logical to presume that Tyrian (who DO know the terms of the deal) know who was in breach.
the fact that it hasn't gone to court pretty much confirms that Bayer has no argument with Tyrians conviction.
