Yes, I too wondered whether the deal between CVS and BKP was on shaky ground. My conclusion was that unless illegality was involved then the deal was a ridgey didge deal between two companies, even though its motives might not be seen as in the best interests of BKP.
Challenging the deal could be a lawyers' delight. If I were the new board of BKP then I would just let CVS sweat over the next two years.
