TIS won the battle regarding its listing as a device, but lost the war when the EU said the trial was not acceptable. They should have come out straight away and said that instead of wasting all that time arguing about the "device". Years and millions wasted. TIS at fault, but the EU can accept a good deal of credit for the fiasco. That the company has survived to this point is something. Such is the belief that the facts and science are credible. Would people have accepted the challenge if it was suspect? I don't think so, and Chris B would not have accepted the challenge without rigorous investigation as to its scientific honesty.
Its a bit like the rise of the Phoenix. Patiently impatient if that makes sense. Excited, and have upped my ante.
