Just so everyone is clear, material facts such as JV, CR exceeding pre approved limits, etc need SH approval. SH really ratify the deal and have the opportunity to question etc.

What you are speaking of is the curcumstances, if the contract just reflects aspirational items then silly fools MLX but I doubt it, this would mean that the announcements released are misleading and deceptive. Nonethess TAM made the announcement by the way about JV and quoted terms "binding'

by the way I am a SH of MLX, I don't have a view, as a SH I entrust the BOD and Mgmt to deal with matters such as this and whatever the outcome is, the BOD needs to be comfortable that they have followed due process and advice. It is what it is.

I am not so much worried about NST making a higher bid, good on them. they need to look after their sh's too. The fact of the matter is there was a prior agreement, was there not. That's what the dispute is about, not that someone has bid or SH being emotional and each BOD needs to act responsibly during the course of their tenure. We'll soon find out what the case may be. I hope for TAM's sake as this could drag on if MLX does have a case. Could you imagine the upside of the NST deal being squandered by court hearings and delays in forming joint ventures. As I said before time is on MLX side, do they really need to worry about sending letters backwards and forwards, delayed court hearings, etc. Someone needs to do their numbers IMHO, if there is a case for MLX.
