Sounds like it will be argument over what kind of agreement then. MLX are claiming both parties were obligated to work towards satisfaction of various approvals. If that process had already begun then I would have thought they would be shown to be in some type of partnership. I guess it all comes down to if TAM had taken any steps with MLX before reaching a further agreement with NST.
As John Utah also said there would be exclusivity in the agreement somewhere..
