The claim sounds, at best, a try on to induce ASP to accept a lower amount for the loan note.
The good news is that it is likely to bring both parties to the table.
No one is really valuing the loan note anyway. Resolution of the matter and a significant cash inflow for ASP (even if it’s not the $6m) would be very well received.
